Registered at the Court of Bucharest under no. 13494/2013, CUI: 32311471, understands to update its personal data processing policy in order to comply with the new rules introduced by Regulation no. 679/2016.
What is this Policy?
With this Policy we bring you to your attention:
• Certain important concepts related to personal data;
• What personal data we process;
• How we use this data;
• To whom we can transmit the data;
• What rights do you have regarding the data.
What is personal data?
"Personal data" means any information or information that identifies or can identify you directly or indirectly. This means that personal data includes information such as: name, surname, email address, home address, phone number, username, profile photos, location data, etc. These could also include unique numerical identifiers, such as the IP address of your computer̆ or the MAC address of your mobile devicĕ, as well as cookie modules.
What does the processing of personal data mean?
"Processing" means any operation or set of operations performed on personal data or sets of personal data, with or without the use of automated means, such as collection, recording, organization, structuring, storage, adaptation or modification, extract, consult, use, disclose by transmission, disseminate or otherwise make available, align or combine, restrict, delete or destroy.
How should the data be processed?
• Fairly, legally and transparently;
• Collected for specified, explicit and legitimate purposes;
• Adequate, relevant and limited in relation to the purposes for which they are processed ("data minimization");
• Correct and updated;
• Kept in a form that does not allow the identification of the persons concerned for longer than is necessary in relation to the purpose of the processing;
• Processed in accordance with the data subject's rights and in a way that ensures adequate security and protection against unauthorized or unlawful processing and against loss.
What does this Policy cover?
The policy we implement covers all Veridica services regardless of the way in which they are offered.
The policy applies to the processing of personal data of:
• To our contractual partners such as suppliers, sellers, customers ("Commercial Partners");
• To the visitors and users of our websites that can be accessed at the addresses europafm.ro, voicenews.ro and omaga.ro ("Users");
• Users of Veridica Mobile Applications ("Application Users")
• To persons interested in participating in our programs or contests ("Applicants");
• To participants in our programs or contests (“Participants”).
What categories of information do we collect about you?
• Information you provide to us
We collect and process your personal data when you interact with us to access the services we provide (for example, the information you provide us by filling in the forms on our websites listed in Section 1 ("Website -uri") or by corresponding with us during the events, by phone, e-mail, WhatsApp or in any other way.
This includes information you provide when you register to use a Website of ours, when you subscribe to our services, when you search for a Veridica audio-visual program, participate in discussion forums or in other social communication activities of on one of our Websites, when you sign up to participate in Veridica shows, by filling in a registration form or otherwise, when you sign up for contests, promotions or studies organized by Veridica and/or its contractual partners and when you report a problem with our Websites.
The information you provide to us in this way may generally include identification and contact data (surname, first name, address, email address and telephone number, personal description and photograph, age, date of birth and gender, as well as other information, as the case may be, if they are relevant for the service offered).
• Information provided by the technology you use
Every time you visit our Websites, we collect the following categories of data, according to the settings that you can manage at any time, from any page, by accessing the "CONFIDENTIALITY" button:
• Technical data, for example this may include the Internet Protocol (IP) address used to connect as your internet computer, login information, browser type and version, time zone setting, browser extension (plug-in) types and versions, operating system and platform, device type and mobile device brand; this data may be collected and processed on our behalf through third-party cookie files and you can find more information about this on the dedicated page;
• Data about how you use our services, for example this may include full Uniform Resource Locators (URLs), sequence of clicks to, through and from our Websites (including date and time), the information or products you viewed or searched for (including top articles read, top categories accessed, page response times, download errors, duration of visits to specific pages (including average time spent on specific pages, watching specific content or videos), time average time spent in an application and the number of views from such applications, the average number of items viewed on our Websites, information about page interaction (such as scrolling, clicks and mouseovers), the methods used to navigate the page, data about User behavior and any telephone number used to call or any email address used to contact our customer service representatives.
• Sensitive data – We will not collect or process sensitive personal data about you (for example, information about your racial or ethnic origin, political opinions, religious or philosophical beliefs, health, sex life or sexual orientation), unless this sensitive personal data is relevant for a specific purpose for which we process the personal data, such as your participation in Veridica broadcasts, as detailed in Section 7 below (for example, if you participate in a broadcast about politics, it is possible to ask you about political opinions); where you have provided us with your explicit consent separately.
If you voluntarily provide us with personal data (including sensitive personal data) through your interaction with our Websites or by corresponding with us by telephone, e-mail or otherwise, of your own free will and not at our request, we will delete such personal data from our systems if we do not believe that its processing is necessary for a legitimate purpose of Veridica, unless you have made this data public (for example, in a forum messages that are visible to the public).
How and on what grounds do we use personal data?
We must have a legal basis to process personal data. It is called "lawfulness of processing".
Sometimes we will ask for your consent, such as when communicating with you (for example when you open an account on our site, when we want you to participate in certain campaigns, competitions or for marketing purposes) or where we process sensitive data. In these cases, we will ask for your consent separately, transparently, when you provide your personal data. Afterwards, you will be able to withdraw your consent at any time via the e-mail address redactie@veridica.ro or directly from the account created on europafm.ro if the consent and/or data were provided via the Website.
However, the withdrawal of consent will not affect the legality of any processing that took place before its withdrawal.
In other cases, we do not ask for your permission to use your personal data, but we use other legal grounds for processing, namely when the legal provisions allow us to do so and if they correspond to your rights.
Thus, we can process your personal data:
• to conclude or execute a contract we have entered into with you (applicable in particular to Business Partners);
• to provide our services;
• to comply with a legal obligation (for example, applicable accounting and tax laws when you win a prize in a competition);
• when necessary for our legitimate interests (or those of a third party) and your interests (for example, to detect and prevent fraud or to ensure IT and network security), unless your fundamental rights prevail against these interests;.
• for various technical, administrative and operational reasons, such as to ensure that we present content in the most effective way for youstr and for your computer; to improve our Websites, including its functionality; for the administration of our Websites;
• for internal operations, including troubleshooting, data analysis, testing, statistical and research purposes;
• for advertising and marketing, including for specific marketing purposes, so that we can provide content, including personalized content, that may be of greater interest to you;
• to contact you (for example to respond to a request, to keep you informed of changes or updates to our policies and practices, to respond to you when you contact us)
• as part of our efforts to keep our Websites secure, accurate and up-to-date.
If we require personal data to comply with legal or contractual obligations, your provision of such personal data is mandatory. This means that if such personal data is not provided, we will not be able to manage the contractual relationship or fulfill the obligations imposed on us. In all other cases, the provision of personal data is optional and you are not obliged to provide it.
We may also process your personal data, such as identification data, contact data and residential address, for the purpose of the possible exercise of our rights or claims against you in the future. This processing is based on our legitimate interest, being necessary to exercise our rights in case of possible disputes.
We will most commonly use your personal information in the following situations:
• Users and customers:
For the purpose of providing services, delivering goods and making payments under relevant contracts (including subscriptions), we may process your personal data, such as identification data, contact data, bank data. This processing is based on the performance of a contract to which Users (especially subscribers) are a party or on a legal obligation imposed on us.
We may process your personal data so that we can provide you with information about goods or services that we believe may be of interest to you.
If you are an existing customer, we will only contact you by email, SMS or push notifications via the Mobile Applications (as applicable) with information about goods and services similar to those that have been the subject of a previous sale or negotiation with you for sale, unless you have previously opted out.
If you are a new customer, we will only contact you by electronic means if we have your prior consent. If you do not want us to use your data in this way, please tick the appropriate box on the form by which we collect your data in the registration form. If you have installed a Mobile Application and wish to stop receiving push notifications, you can change the settings on your mobile device or through the settings in the Mobile Application.
We will not share your personal data with third parties for marketing purposes without your explicit consent in this regard (see also the cookie policy on the europafm.ro website).
We may also use your personal data to measure or understand your preferred content related to the programs and to provide content relevant to you; to enable you to participate in the interactive features of our Service when you choose to do so; to measure or understand the effectiveness of the advertising we serve to you and others and to provide you with relevant advertising; and to make suggestions and recommendations to you and other Users of our Websites about products or services that may be of interest to you or them.
• Candidates and Participants:
In connection with your appearance and/or participation in the production or recording of a Veridica media production, we may collect and process your personal data, including sensitive data, as mentioned in Section 6 above, for the purposes of screening, selection , your recording, appearance or participation in such productions or recordings for that program or media production and other such programs or productions, as well as communication with you and others in connection with the above (references to all of these together are in the form "for the purpose of participating in Veridica broadcasts").
This processing may be based on Veridica's legitimate interest or the performance of a contract to which you are a party (for example, when you complete a registration form or sign an agreement/con contract before such appearance/participation) or on consent, in the case of sensitive data.
In connection with participation in contests, we may collect and process your personal data based on your registration for the respective contest, according to the Contest Regulations.
Under the same conditions as shown, depending on the character or nature of a particular program or other media production (video or audio), we may also broadcast or publish your photographs, video recordings, audio recordings or audiovisual recordings.
We may also process your personal data within and in connection with certain productions or recordings and the broadcasting or public communication of such productions or recordings for certain journalistic, artistic and/or literary purposes.
For the avoidance of doubt, the provisions of this Policy do not affect copyright and other intellectual property rights relating to productions and recordings of television programs or other media productions.
• Application Users:
In connection with your use of our mobile applications, we may collect and process your personal data, such as identification data, contact data, debit or credit card information and geographic location data, when:
• register to use our Mobile Applications (including free trials) and provide us with information about yourself;
• provide a comment, rating or other post using our Mobile Applications;
• interact with us using our Mobile Applications;
• interact with us by other means, such as by phone, fax, SMS, email, social media or postings in connection with a Mobile Application;
This processing may be based on
• execution of a contract to which Application Users are party by registering in such Mobile Applications;
• our legitimate interests to verify user account data for services provided in the territory in which you are habitually resident and for the detection and prevention of fraud;
• a legal obligation imposed on us;
• your consent to informational messages about the programs and services offered by Veridica and/or our Affiliated Companies, newsletters, subsequent promotional campaigns and other marketing information sent by or on behalf of Veridica and/or our Affiliated Companies.
How and to whom we disclose your personal data
We do not sell your personal data to third parties.
Within the Company, only a limited number of staff members, such as those from the Sales, Legal, Production, Marketing, News and IT departments have access to your personal data on a need-to-know basis ("on a need to know basis"). These staff members are subject to confidentiality obligations regarding personal data. Adequate technical and organizational measures are taken for the protection of personal data. The Company's staff members have the right to manage personal data only at the Company's instructions and, if necessary, in connection with their job responsibilities.
Personal data may be disclosed to government authorities and/or law enforcement bodies if this is required by applicable laws or if it is necessary to exercise our rights, including the terms of use, or to protect our legitimate interests (including legitimate interests of third parties) in accordance with applicable laws.
Some of your personal data may also be disclosed to third parties, including:
(i) service providers who provide administrative, professional and technical support to the Company for IT support, security and business resources;
(ii) business partners (including contest partners, sponsors, etc.), suppliers and subcontractors for the performance of all contracts we enter into with you (including subscriptions to our services);
(iii) advertisers and ad networks that request your information to select and serve advertisements relevant to you. We do not disclose personally identifiable information to advertisers, but we will provide aggregated and anonymized information about our Users to them. We may also use such aggregate information to help advertisers reach the type of audience they are targeting. We may use the personal information we have collected from you to comply with your wishesthe purposes of advertising agencies by displaying their advertising messages to the target audience;
(iv) analytics and search engine service providers that help us improve and optimize our Websites.
The Company may also disclose personal data to external consultants (eg lawyers, accountants, auditors) if necessary.
We have implemented appropriate safeguards in our relationship with our partners to secure these disclosures of personal data.
We may share personal data with our Affiliates and other third parties in the context of certain types of transactions, including in the context of transactions involving a change of control of the Company, the sale of substantially all of its assets, or business restructuring.
The Company wishes to perform appropriate due diligence in selecting third party service providers and requires such service providers to maintain appropriate technical and organizational security measures to protect personal data and to process personal data only as directed by the Company. Service providers will be entitled to use subcontractors in providing the services to the Company, provided that the subcontractor complies with the same data protection obligations as the service providers.
1. Storage of your personal data and transfers abroad
Your personal data that we collect is stored in the European Union ("EU") and the European Economic Area ("EEA"). However, information collected by third parties through cookies (eg through Google Double Click for Publishers) will generally serve traffic from a data center closest to where it originates the traffic. This means that such information, including advertising traffic, may be handled by servers located in the EEA and may be transferred outside the EEA.
We do not transfer your personal data outside the EEA unless adequate safeguards are in place, including:
• an adequacy decision issued by the European Commission regarding the country or countries of destination;
• a "privacy shield" certification;
• corresponding mandatory corporate rules;
• an approved code of conduct, together with the binding and enforceable commitments of the data controller or the person authorized by the data controller in the country outside the EU and EEA;
• an approved certification mechanism, together with the binding and enforceable commitment of the data controller or the person authorized by the data controller in a non-EU and EEA country to apply the appropriate safeguards;
• standard EU contractual clauses approved by the European Commission or standard clauses approved by the National Supervisory Authority ("ANSPDCP").
1. Your rights
Personal data are your property, so you have the following rights:
• you can ask us to confirm whether or not your personal data is being processed by us, to provide you with a copy of your personal data and/or to correct it.
• in certain circumstances, you have the right to ask us to delete your personal data or, based on the right to portability, to ask us to transfer some of your personal data to you or to other entities.
• you also have the right to object to or restrict the processing of your personal data (for example, the use of processing for direct marketing purposes or certain decisions made only through automated processing (including profiling).
• if we have requested your consent for the processing of personal data, you have the right to withdraw this consent without negative effects on you and without affecting the legality of the processing carried out on the basis of the consent prior to its withdrawal
Note that your rights described above may be limited in certain situations and are subject to applicable laws and regulations regarding the protection of personal data; for example, your right to object to the processing of your personal data may be limited if we can demonstrate that we have compelling legitimate grounds to process your personal data that override your interests or an applicable legal provision requires data processing.
When you exercise any of the above rights, you will need to prove your identity and provide us with other details to help us respond to your request.
We will not charge a fee to respond to your request unless this is permitted dis the law and, if such a fee is charged, it will be reasonable and proportionate to your request.

We hope we can satisfactorily answer all your questions about how we process your personal data. However, you also have the right to file a complaint with the data protection supervisory authority. You can file your complaint in the Member State where you live, work or where the alleged breach of data protection law took place.
How long we keep your personal data
We intend to retain your personal data only for as long as necessary in accordance with our Data Retention Policy, for a period not exceeding the period necessary to fulfill the purposes listed in this Privacy Policy and/or required by applicable law, in accordance with the applicable minimum legal retention periods and/or as necessary to exercise our legitimate rights (and the legitimate rights of others).
For example, if you are a Business Partner, we will keep your personal data for the duration of the contractual relationship with you. Where we have an ongoing business relationship with you as a Business Partner (for example where we may use the same personal data in separate contractual relationships with you), we will continue to retain such personal data until termination our business relationship and for the minimum retention period required by law, subject to our Data Retention Policy.
In the case of Application Users, we will retain your personal data for the period during which the Mobile Application is downloaded or the period indicated by relevant legislation, subject to our Data Retention Policy. Please note that we may process any of your personal data after it has become anonymous without prior notice.
If we process your personal data based on your consent, this personal data will only be processed for the period provided for by your consent, unless you withdraw or limit your consent before the expiry of this period.
Data security
We want to keep your personal data safe! That's why, when we create new services and technologies, we take this principle into account.
We store your data on our servers and on servers hosted by third parties (including cloud-based services of third parties). We use appropriate technical and organizational measures to protect your personal data and prevent unauthorized access. We have entered into contractual relations with third parties that offer hosting services and these contracts include obligations regarding the organizational and technical security of personal data.
You must take care to maintain the confidentiality of all means of authentication (for example, passwords) used by you to access parts of our Websites, otherwise we will not be able to protect you.
Data transmission over the Internet is not completely secure. Although we will do our best to protect your data, we cannot guarantee the security of your data transmitted on our Websites. After we receive your data, we will use strict procedures and security features to try to prevent unauthorized access.
Confidentiality of minors' data
The Company does not knowingly collect personally identifiable information from persons under the age of 16 on its Websites. If a parent or guardian becomes aware that their children have provided the Company with their personal data, they must immediately inform the Company. If the Company discovers that a person who has not reached the age of 16 has provided it with personal data, the Company will destroy such information from its servers immediately, unless the parent or guardian gives explicit consent to the processing of to the company of the child's personal data for the specified purposes.
Cookies and social communication widgets
Our Websites use cookies to distinguish you from other Users of our Websites. This helps us provide you with an experiencegood when you browse our Websites and also allows us to improve our Websites. This processing is based on your consent expressed on our Websites or through the settings in your browser. For detailed information about the cookies we use, how long we use them and the purposes for which we use them, see our Cookie Policy. Also, to set cookies, access the "Privacy" window on the website. When accessing the site, only the cookies necessary for its operation are set.
Our websites may include social communication features, such as Facebook, Twitter, Instagram, LinkedIn or YouTube buttons. These features may collect information about you, such as your IP address and the websites you visit, and may set a cookie to allow it to function properly. The processing of this information through interactions with these features is governed by the privacy notice/policy of the company providing it.
Links to other websites
A Website of ours may provide links to websites that the Company does not control. After you click on a third party link, you will be directed to the third party's website. If you visit any of these linked websites, you should review their privacy policies. We are not responsible for the policies and practices of other companies. Our company does not control and assumes no responsibility for the content, privacy policies and notices or practices of third party websites or services.
